the Supreme Court better over rule this !

if they end up having no reason to come in, unless you are arrested, good luck trying to protect your 4th Amendment rights after the fact :-(

Court: No right to resist illegal cop entry into home

I read that the officer were responding to a domestic. Police officer are mandated to react to those calls different then most other calls. State law requires us to determine if someone is in danger. Retreating to the house does not allow us to just leave and say we could not make contact. Domestics have become very difficult to handle. If someone is even slightly injured the other party is going to jail (mandatory). We are not given a choice to just walk away or let them leave. In the situation as written and I read it, the officer could not just leave when the parties went into the house. What if the aggressor forced the other half into the house and the officers left, then the aggressor continued the aggression? Officer are mandated to find out if it verbal or physical and if verbal, is it over, if physical then your taking someone to jail period. Domestic laws have forced the officers to react as in the case mentioned.

but if I hear you correctly, then there was no need for this judgement -- i.e. the law is already clear on what can / can't be done ...?

Thats if the article has all the facts and they are stated correctly.
 
I live in Indiana where this court ruling happend.
The you know what has hit the fan over this ruling.
It is already going to be appled,plus some state sen. and rebersenitves are talking about doing something about the court ruling.
I thought the days of nazi germany and the gestopo and the russian kbg.were gone but no they just came to Indiana.
